Three Years After The Load Left, Someone Asks For Their Copy Of The Manifest.

Chapter 4 does not put the retention duty on one party. The generator holds the record for three years, the transporter holds it for three years, and the receiving facility holds it for three years, each of them separately. A haul ticket book tracks none of that, and neither does the spreadsheet that replaced it.

The Railroad Commission rewrote the Texas oilfield waste rules and moved three ordinary parts of a haul into regulated records with their own numbers, their own dates and their own retention. Nothing about the truck changed. Everything about the paperwork behind it did.

A stream is characterised on a waste profile before it leaves the lease. A shipment with no profile is not merely incomplete in this register, it reads as blocked — because that is what it is.

Waste moved by vehicle to an off-lease facility travels under a manifest. A pipeline movement is not manifested at all, so this register swaps those fields for the mass-balance note that takes their place.

Three years, three parties

§4.194 puts the three-year retention on the generator, the transporter and the receiving facility independently. Three copies of one record, three clocks, any one of which can be the one someone asks for.

A billing ticket proves the truck came.
It does not prove the waste was legal to move.

The profile gates the shipment

Enter a load with no profile number and no profile date and it does not sit quietly in a list. It sorts to the top as blocked, with the reason written out: the stream is characterised before the waste moves, so this one should not have been released.

The permit is checked on the right day

A waste hauler permit is not judged against today. It is judged against the date each load actually shipped, so a permit that lapsed in March shows up against the loads it touched in April rather than quietly passing because it was renewed since.

Three clocks, kept apart

Each shipment carries a generator deadline, a transporter deadline and a receiving-facility deadline, each named to the party that holds it. When one of them cannot produce their copy, you know whose obligation was still running and whose had ended.

One status per movement, worked out from the record itself.

Nothing is set by hand. The status comes from what is on the record: whether the profile exists, whether the hauler permit was current on the ship date, whether the manifest or the mass-balance note is there, and whether the receiving facility has taken it. Worst sorts to the top, so the register opens on the things that need doing.

The six states a shipment can be in

Every load on the register carries exactly one of these.

  • Profile missing — no waste profile against the load. It sorts above everything else, because it is the one state that means the movement should not have happened.
  • Hauler permit expired — the transporter’s permit had lapsed on the date the load shipped, with the expiry and the ship date both spelled out.
  • In progress — profile on file, no manifest number or ship date yet. A pipeline movement reads this way until the mass-balance note is entered.
  • In transit — manifest complete and gone, no received date back from the facility. Nothing is late; the retention clock simply has not started.
  • Retention active — received, with the remaining hold shown for each of the three parties and a warning window before it ends.
  • Retention elapsed — the three years are up on all three copies. It stays on the register, marked, rather than disappearing on you.

What each record carries

Generator and site
Generator or site name, lease or RRC identifier, and the operator name and P-5 number that head the audit sheet.
Waste stream
Produced water, mud, cuttings, tank bottoms, completion fluid, sand and sludge, contaminated soil, NORM-bearing material, or anything else, with the quantity.
Waste profile
Profile number, profile date and the characterisation basis — laboratory analysis, process knowledge, generator knowledge or field screening.
Origin
In-state or interstate, and where interstate, the origin that Chapter 4 requires to be identified and tracked into Texas.
Transport
By vehicle or by pipeline. Vehicle takes a manifest number, a transporter and a unit number; pipeline takes a mass-balance note instead.
Transporter and permit
Hauler name, waste hauler permit number and permit expiry, held once on the hauler and checked against every load that names them.
Receiving facility
Facility name and permit number, the ship and received dates, and whether the signed copy has come back.
Retention
Hold-until date and remaining time for the generator, the transporter and the receiving facility separately, at three years or whatever longer period your own policy sets.
